GENERAL

The following terms apply to NON-COMMERCIAL artworks only. i.e. If you intend to make profit off the art I make for you, do NOT order from me. Art for stream usage, such as VTubers, is considered OC and thus, personal, art.

The digital signature and watermark must remain on any future uploads of the finished commission.

Commission prices are allocated for art pieces that include one (1) character [excluding when specified in pricing descriptions]. Any further characters to be added may incur a larger price tag. This will be discussed before the final invoice will be sent.

If you are requesting art that is NSFW in nature (sexual, fetish, kink, nudity, etc), you are confirming that you are over the age of 18. I have a right to refuse the commission if I suspect you are underage, but otherwise, you are responsible for the content you receive and I am not to be held liable if you are a minor.

Any commission detailing imagery which is racist, homophobic, transphobic or discriminates along the axes of culture, gender or religion or is otherwise hateful will be instantly declined. This is non-negotiable.

Commissions will only be accepted for characters that you personally owns the rights to, have explicit written permission for, or they exist within a fandom where the copyright law of transformative works would take effect.

I'm capable of illustrating almost every race or species; fantasy, real life or mechanical. However, some commissions may be refused on the basis of subject matter due to personal discomfort or skill level. I am permitted to decline any commission without reason, however will likely supply a reason out of courtesy.

PAYMENTS

Payment is required to be paid in full upon the commission being accepted, unless the total fee is over 200 AUD. In this case, it is permitted to pay a 50% up-front fee at the commencement of the commission, followed by the final 50% at completion.

In the event that you choose to pay in installments, ownership of the commission and final copy of the art will not be supplied until the final payment is made.

REVISIONS

You will be supplied two previews in the sketching stage of the project, in which you can request major edits. Major edits include things like stylistic changes, pose alterations, or completely new project attempts. Any alterations made after the previews will increase costs to accommodate for the extra time that will be required to complete the art piece.

Beyond these two alteration previews, I supply watermarked previews of the art at all stages of the process. These include; sketches, lineart, flat-colours, rendering and background + detailing. This is to make sure you are okay with each stage as I progress.

Minute changes as I progress with the commission are likely okay, discussed on a case-by-case basis. These include items such as; colour changes, small unmentioned details [such as freckles or small scars], or small changes like facial expressions.

DEADLINES AND DELIVERY

My commissions work on a 4 month turnaround, at latest. I understand this is a broad amount of time, for commissioners, and assure them that this is the longest that a piece will take from initial payment to final render. Any time to be taken beyond this will be clearly communicated with the commissioner as issues arise. I request understanding with commissioners as I am a full-time software engineer alongside commission work.

Art to be completed on a deadline will incur higher commission prices, proportional to the time in which the commissioner wishes for the piece to be completed by. The shortest duration of time I will consider a rush commission is three days.

Commissioned work will be supplied to the commissioner in .png format, at its original resolution [most pieces I work with are A5 resolution and 350 dpi]. In the case of v-tuber models [unrigged], I will also supply a .psd file with appropriate layering.

USE

Personal online use of the commissioned art may be allowed as long as it falls under the following; personal avatar on social media accounts or websites, or portfolios used for 'original character' tracking and detailing [such as Toyhou.se]. Any other personal online uses not mentioned here will be discussed on a case-by-case basis.

All uploads of the commissioned art to online spaces, however, must provide credit to me and link to one of my social media, or this portfolio.

Commercial use, profit or distribution of the commissioned art, regardless of details, is disallowed. If my art is the only art for a character, you may not sell the character design for more than half the cost of the art.

The only exception to this is if I designed the character for you. In which case, inform me before selling, and you may sell for the original price of the character.

INTELLECTUAL PROPERTY RIGHTS

When commissioning me, you are paying for labour and skill only.

Upon completion of the commission, I retain all rights, copyright and commercial, to the finished art product. This includes, but is not limited to, full use of the art on my personal portfolios, both online and offline, and in using the art for prints if you do not own the rights to the character.

As a result of this, you may not replicate, reproduce, trace, alter the commission in any capacity, or otherwise claim as yours.

My art, irregardless of whether you purchased the commission, is not to be used as part of a crypto, NFT, or any other blockchain application. It is also prohibited to use my art in the training of AI models.

REFUNDS

If you are dissatisfied with the quality of the art received, you have seven (7) days from receiving the final commission to initiate contact to rectify the situation. If contact is not made within those seven (7) days, the art received and payment made is final.

You "changing your mind" or personally disliking the final product are not grounds for a refund. Quality dissatisfaction (including instances of low image quality and the commission being unlike supplied art style examples) may be discussed to receive a refund or alteration.

Full refunds will not be supplied for completed digital commissions.

Refunds will be issued on a case-by-case basis, determined from the amount of work completed, reasons for refunding and time since the commission was placed.

If requesting a refund, it will be conducted through me. Issuing a refund through the payment provider will result in a blacklist.

COMMUNICATION

Communication can occur on any of my mentioned social media or email. I request that commissioners be mindful of the platform they are choosing to contact me on, as social media may not always be reliable for DMs.

Communication from me surrounding your commission will only occur at important stages [as mentioned above] or should issues arise. This communication will occur on the platform you initially contacted me on, and will only occur during the business week. I do not contact commissioners over the weekend, to account for my own personal life.

If a commissioner has paid a deposit, or the final price for commission, and would like to contact me for progress details, in the event of some time since last contact, they are free to do so. I request that these communication attempts to not occur more than once a week. Should the commissioner chose to contact me more frequently, you will not receive a response any greater than weekly.

If the commissioner has not paid a deposit, they should be aware they are waitlist only, and thus, communication will be at my discretion and the completion of commissions in queue before them
